We have considerable expertise in advising lenders on complex issues of taking security and our advice is geared towards ensuring that the lenders are provided with the most efficient security package. We have in-depth understanding of the issues surrounding the enforcement of security and what sets us apart is the constant interaction between our advisory practice and our contentious work, such that our advice is always commercially-driven whilst always appreciating and anticipating issues from a contentious angle. The fact that we also have a strong insolvency practice is a distinct advantage as it enables us to advise our financial institution clients as to the most insolvency-remote security package that they may wish to ask from the borrowers, as well as to advise them as regards issues of priority and subordination, amongst others.

In addition to a very strong lender-side finance practice, we also boast solid experience in acting for the world’s leading corporates. The versatility of our banking and finance practice is such that we regularly provide advice in relation to the full spectrum of financial products including syndicated lending, acquisition finance, asset finance, derivative products, project finance, financial regulatory and structured finance. On the capital markets side, we regularly advise in connection with listings, bond issues, bond redemptions, and securitisations. We have, for example, been awarded the Securitisation & Structured Finance Deal of the Year by China Law & Practice for the Dynasty Assets’ CMBS transaction in 2007.

Within our banking and finance practice, we regularly advise on ground-breaking deals that span across a number of industries and sectors, with particular focus on oil & gas, minerals, energy & infrastructure, and across a number of jurisdictions, with a strong track record on the emerging markets, including India and Africa.
